1200w\" sizes=\"auto, (max-width: 767px) 89vw, (max-width: 1000px) 54vw, (max-width: 1071px) 543px, 580px\" \/><\/figure>\n\n\n\n<p><strong>On August 31, 2018<\/strong>, the <strong>Order of the Ministry for Regional Development No. 158 dated 03.07.2018<\/strong> entered into force:<br><strong>\u201cOn the approval of the Procedure for technical inspection and commissioning of individual (homestead) residential buildings, garden and summer houses, auxiliary (subsidiary) buildings and structures, and agricultural buildings and structures classified as low-consequence (CC1) objects, constructed on land plots with appropriate designated purpose without a construction permit.\u201d<\/strong><br>(This is the so-called <em>Building Amnesty<\/em>.)<\/p>\n\n\n\n<p><strong>The Building Amnesty<\/strong> is a simplified procedure for commissioning, in particular, individual (homestead) residential buildings, garden and summer houses with a total area of up to <strong>500 square meters<\/strong>, as well as household (subsidiary) buildings and structures with a total area of up to <strong>500 square meters<\/strong>, constructed (without proper permits) <strong>between August 5, 1992 and April 9, 2015<\/strong>, provided they are built on land plots with the appropriate land use designation.<\/p>\n\n\n\n<p>\ud83d\udccc Commissioning a house under the building amnesty <strong>does not require<\/strong> obtaining a <strong>building passport<\/strong>, <strong>development intent scheme<\/strong>, and\/or <strong>construction start permit<\/strong>.<\/p>\n\n\n\n<p><strong>Previous building amnesties:<\/strong> Over the past 14 years, there were two more building amnesties:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>First<\/strong> \u2014 was in effect from <strong>July 25, 2011 to January 30, 2013<\/strong>, and was regulated by the <strong>Order of the Ministry for Regional Development No. 91 dated 24.06.2011<\/strong>.<\/li>\n\n\n\n<li><strong>Second<\/strong> \u2014 was in effect from <strong>May 26, 2015 to December 31, 2015<\/strong>, and was regulated by the <strong>Order No. 79 dated 24.04.2015<\/strong>.<\/li>\n<\/ul>\n\n\n\n<p>Both of the above amnesties were <strong>limited in duration<\/strong> (the 2015 amnesty lasted only 7 months).<br>The <strong>current amnesty<\/strong>, effective since 2018, is <strong>open-ended<\/strong> (not limited in time).<\/p>\n\n\n\n<p>\ud83c\udfaf <strong><em><a href=\"https:\/\/dreamdim.ua\/uk\/ob-yekty-yaki-mozhna-buduvaty-bez-dozvolu\/\" title=\"\">Types of construction that do not require permits or occupancy approval<\/a><\/em><\/strong><ins class=\"adsbygoogle\" style=\"display:block\" data-ad-format=\"fluid\" data-ad-layout-key=\"-fb+5w+4e-db+86\" data-ad-client=\"ca-pub-2601889031568289\" data-ad-slot=\"5406117927\"><\/ins><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Procedure and Required Documents<\/strong><\/h3>\n\n\n\n<p>To formalize (<a href=\"https:\/\/dreamdim.ua\/uk\/vvedennya-v-ekspluatatsiyu-2023\/\" title=\"\">commission<\/a>) individual (detached) residential houses, garden and summer cottages, and household buildings and structures, one must submit a set of documents as defined by <strong>Order No. 158<\/strong> to the <strong>State Architectural and Construction Control Authorities (DABC)<\/strong> \u2014 either:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>in person via the <strong>Administrative Services Center (CNAP)<\/strong>,<\/li>\n\n\n\n<li>by postal mail,<\/li>\n\n\n\n<li>or electronically via the <strong><a href=\"https:\/\/diia.gov.ua\/\" title=\"\">Diia government portal<\/a><\/strong>.<\/li>\n<\/ul>\n\n\n\n<p>I recommend submitting documents <strong>electronically<\/strong>, as this not only saves time but also <strong>minimizes the possibility of unjustified rejections<\/strong> of the submitted declaration. That\u2019s because almost all the data required for filling in the declaration is automatically populated by <strong>Diia<\/strong>.<br>Documents falling within the jurisdiction of <strong>DIAM<\/strong> are typically <strong>registered within 3 to 5 days<\/strong>.<\/p>\n\n\n\n<p>To submit documents electronically, <strong>land rights must be registered<\/strong> in the <strong>State Register of Property Rights<\/strong> so that the <strong>Unified State Electronic System in the Field of Construction (EDESSB)<\/strong> can automatically retrieve information about the owner\/user of the land plot.<br>This also allows for cross-checking the data indicated in the declaration, the <strong>technical passport<\/strong>, and the <strong>State Register of Property Rights (DRRP).<\/strong><\/p>\n\n\n\n<p>A <strong>technical passport<\/strong> is a mandatory document that must be submitted (or at least referenced in the declaration).<br>It is important that the technical passport is <strong>registered in the Unified State Electronic System in the Field of Construction (EDESSB)<\/strong> and must have a registration number in the following format: <code>TI01:XXXX-XXXX-XXXX-XXXX<\/code>.<\/p>\n\n\n\n<p>Commissioning is carried out <strong>free of charge<\/strong> by the <strong>State Architectural and Construction Control Authority<\/strong> within <strong>10 business days<\/strong> from the date of submission of:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the corresponding application (if submitted via CNAP),<\/li>\n\n\n\n<li>certified copies of land ownership documents,<\/li>\n\n\n\n<li>the technical passport,<\/li>\n\n\n\n<li>and a completed declaration of readiness for operation.<\/li>\n<\/ul>\n\n\n\n<p>In cases where the total area of household (subsidiary) buildings and structures <strong>exceeds 100 square meters<\/strong>, the applicant must additionally submit a <strong>technical inspection report<\/strong>.<\/p>\n\n\n\n<p>Changes to the area threshold (above which the technical report is required) may be introduced soon \u2014 stay informed via our <strong><a href=\"https:\/\/t.me\/UrbanDataUA\" title=\"\">Telegram channel<\/a><\/strong>.<\/p>\n\n\n\n<p>A registered declaration of readiness for operation (provided the building has an assigned address) constitutes a legal basis for <strong>registering property ownership rights<\/strong>.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Regarding the area of household (subsidiary) buildings<\/h3>\n\n\n\n<p>According to the data available to me for the years <strong>2023\u20132024<\/strong>, the situation is as follows:<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"923\" height=\"348\" src=\"https:\/\/dreamdim.ua\/wp-content\/uploads\/2025\/06\/DREAMDIM_gosp.png\" alt=\"\" class=\"wp-image-8554\" srcset=\"https:\/\/dreamdim.ua\/wp-content\/uploads\/2025\/06\/DREAMDIM_gosp.png 923w, https:\/\/dreamdim.ua\/wp-content\/uploads\/2025\/06\/DREAMDIM_gosp-300x113.png 300w, https:\/\/dreamdim.ua\/wp-content\/uploads\/2025\/06\/DREAMDIM_gosp-768x290.png 768w\" sizes=\"auto, (max-width: 767px) 89vw, (max-width: 1000px) 54vw, (max-width: 1071px) 543px, 580px\" \/><\/figure>\n\n\n\n<p>In my opinion, it would be appropriate to amend the legislation and increase the <strong>area threshold for household (subsidiary) buildings that can be commissioned without a technical inspection report<\/strong> \u2014 from <strong>100 m\u00b2 to 300 m\u00b2<\/strong>.<br>This recommendation is based on the fact that, in most cases, such inspection reports are <strong>purely formal<\/strong> and result only in <strong>additional financial burdens<\/strong> for property owners.<\/p>\n\n\n\n<p>It is also important to clarify that <strong>not all household buildings and structures are counted<\/strong> within the prescribed <strong>100 m\u00b2 or 500 m\u00b2<\/strong> limits.<br>For example, structures <strong>without foundations<\/strong> are generally <strong>excluded<\/strong> from the total calculated area.<\/p>\n\n\n\n<p>When discussing the <strong>combined area<\/strong> of residential buildings and household structures, it should be clearly understood that <strong>previously commissioned buildings are not subject to re-commissioning<\/strong>, except in cases of reconstruction.<br>As a result, it is entirely possible that a land plot already contains properly legalized structures totaling <strong>90 m\u00b2<\/strong>, and an <strong>unauthorized garage of 45 m\u00b2<\/strong> has been added.<br>In this scenario, only the <strong>45 m\u00b2<\/strong> garage will be subject to the simplified commissioning procedure \u2014 not the cumulative <strong>90 + 45 m\u00b2<\/strong>.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>\u0412Lack of urban planning documentation and non-compliance with <a href=\"https:\/\/dreamdim.ua\/uk\/vidstani-mizh-budynkamy-2024\/\" title=\"\">setback requirements from property boundaries and adjacent buildings<\/a><\/strong><\/h3>\n\n\n\n<p><strong>The Construction Amnesty (2018\u20132025)<\/strong> has been and continues to be a valuable tool for those who intended to legalize their buildings but were unable to do so due to the <strong>absence of approved urban planning documentation<\/strong> in their locality \u2014 such as a <strong>general plan (master plan)<\/strong> or a <strong>detailed territorial plan (DTP)<\/strong>.<\/p>\n\n\n\n<p>The <strong>lack or cancellation<\/strong> of approved urban planning documents has been, and still is, a <strong>valid reason for denial<\/strong> of a <strong><a href=\"https:\/\/dreamdim.ua\/uk\/budpasport-2023\/\" title=\"\">building passport<\/a><\/strong>, as per the <strong>Procedure for Issuing Building Passports<\/strong> (Order of the Ministry of Regional Development of Ukraine No. 103, dated July 5, 2011). A building passport is a mandatory prerequisite for submitting a <strong>notification on commencement of construction works<\/strong>.<br>The same applies to <strong>denials of urban planning conditions and restrictions (UPCR)<\/strong>.<\/p>\n\n\n\n<p>However, the <strong>absence of urban planning documentation or a DTP<\/strong> is <strong>not a barrier<\/strong> to commissioning a building under the <strong>Construction Amnesty<\/strong>, provided it falls under the scope of <strong>Clause 9, Section V<\/strong> of the <strong>Law of Ukraine \u201cOn Regulation of Urban Development Activities.\u201d<\/strong><\/p>\n\n\n\n<p>\ud83d\udccc Furthermore, compliance with <strong>setback requirements<\/strong> (the minimum legally required <a href=\"https:\/\/dreamdim.ua\/uk\/vidstani-mizh-budynkamy-2024\/\" title=\"\">distance between buildings or to property boundaries<\/a>) <strong>is not evaluated<\/strong> as part of the amnesty process.<br>This means that even if a house or household structure is located <strong>directly on the boundary line<\/strong> or just <strong>2\u20133 meters from neighboring buildings<\/strong>, the <strong>declaration of readiness<\/strong> under the amnesty procedure <strong>will still be accepted and registered<\/strong>.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Fines and Fees<\/h3>\n\n\n\n<p>According to <strong><a href=\"https:\/\/zakon.rada.gov.ua\/laws\/show\/3038-17#n712\" title=\"\">Clause 9<\/a>, Section V (&#8220;Final Provisions&#8221;)<\/strong> of the <strong>Law of Ukraine \u201cOn Regulation of Urban Development Activities\u201d<\/strong>, <strong>no fines or penalties<\/strong> are applied to landowners (or land users) who submit documents for <strong>commissioning buildings under the Construction Amnesty<\/strong> procedure.<\/p>\n\n\n\n<p>This means that individuals who <strong>did not obtain permits for construction<\/strong> or <strong>used buildings that were not officially commissioned<\/strong> will <strong>not be subject to sanctions<\/strong>, provided they follow the procedure outlined in the amnesty regulations.<\/p>\n\n\n\n<p>\u2705 <strong>The registration of a declaration under the construction amnesty is free of charge.<\/strong><br>At present, <a href=\"https:\/\/dreamdim.ua\/uk\/budivelna-amnistiya-2022\/\" title=\"\">all proposals to introduce a fee for registration<\/a> have been postponed, although such a <strong>possibility still remains<\/strong> in the future.<\/p>\n\n\n\n<p>\ud83d\udde3 <em>To discuss current regulations and get advice on specific cases related to commissioning under the Construction Amnesty in <strong>2025<\/strong>, you are welcome to join the <strong>\u201c<a href=\"https:\/\/www.facebook.com\/groups\/urban.ukraine\/\" title=\"\">Urban Planning in Ukraine<\/a>\u201d<\/strong> discussion group.<\/em><\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><em><a href=\"https:\/\/www.facebook.com\/groups\/218794585535566\">Yuriy Brykaylo<\/a><\/em>,<\/p>\n\n\n\n<p><em><a href=\"https:\/\/dreamdim.ua\/\">DREAMDIM<\/a>&nbsp;&#038;&nbsp;<a href=\"https:\/\/urbandata.online\/\">URBANDATA<\/a><\/em><\/p>\n\n\n\n<p><em>\u24b8 202<\/em>5<\/p>\n<!-- AddThis Advanced Settings generic via filter on the_content --><!-- AddThis Share Buttons generic via filter on the_content -->","protected":false},"excerpt":{"rendered":"<p>Building Amnesty in Ukraine: Simplified Legalization of Residential and Agricultural Buildings (2025) On August 31, 2018, the Order of the Ministry for Regional Development No. 158 dated 03.07.2018 entered into force:\u201cOn the approval of the Procedure for technical inspection and commissioning of individual (homestead) residential buildings, garden and summer houses, auxiliary (subsidiary) buildings and structures, &hellip;
