{"id":8706,"date":"2025-06-05T03:49:34","date_gmt":"2025-06-05T01:49:34","guid":{"rendered":"https:\/\/dreamdim.ua\/uk\/?p=8706"},"modified":"2025-06-05T04:00:50","modified_gmt":"2025-06-05T02:00:50","slug":"zakonoproekt-pro-zakryttya-dostupu-do-zemelnogo-kadastru-reyestru-rechovyh-prav-na-neruhomist-ta-inshyh-publinyh-reyestriv","status":"publish","type":"post","link":"https:\/\/dreamdim.ua\/en\/zakonoproekt-pro-zakryttya-dostupu-do-zemelnogo-kadastru-reyestru-rechovyh-prav-na-neruhomist-ta-inshyh-publinyh-reyestriv\/","title":{"rendered":"Draft Law on Restricting Access to the Land Cadastre, Real Estate Rights Register, and Other Public Registers"},"content":{"rendered":"\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"576\" src=\"https:\/\/dreamdim.ua\/wp-content\/uploads\/2025\/06\/DREAMDIM_limit_2025_en-1024x576.png\" alt=\"\" class=\"wp-image-8713\" srcset=\"https:\/\/dreamdim.ua\/wp-content\/uploads\/2025\/06\/DREAMDIM_limit_2025_en-1024x576.png 1024w, https:\/\/dreamdim.ua\/wp-content\/uploads\/2025\/06\/DREAMDIM_limit_2025_en-300x169.png 300w, https:\/\/dreamdim.ua\/wp-content\/uploads\/2025\/06\/DREAMDIM_limit_2025_en-768x432.png 768w, https:\/\/dreamdim.ua\/wp-content\/uploads\/2025\/06\/DREAMDIM_limit_2025_en.png 1200w\" sizes=\"auto, (max-width: 767px) 89vw, (max-width: 1000px) 54vw, (max-width: 1071px) 543px, 580px\" \/><\/figure>\n\n\n\n<p><\/p>\n\n\n\n<p>The Committee on Legal Policy has <a href=\"https:\/\/www.rada.gov.ua\/news\/news_kom\/262585.html\" title=\"\">reconsidered <\/a>Draft Law <strong>No. 11533 \u201cOn Amendments to the Civil Code of Ukraine and Certain Other Laws of Ukraine Regarding the Specifics of Providing Information from Public Electronic Registers Maintained by the Ministry of Justice of Ukraine and Certain Other Public Electronic Registers\u201d and adopted a decision to recommend that the Verkhovna Rada of Ukraine, based on the results of the first reading, adopt the above-mentioned draft law as a basis <\/strong>and as a whole in the version proposed by the Committee.<\/p>\n\n\n\n<p>The document proposes amendments to the <strong>Civil Code of Ukraine<\/strong> and a number of Ukrainian laws, in particular:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the <strong>Law of Ukraine \u201cOn State Registration of Property Rights to Immovable Property and Their Encumbrances\u201d<\/strong>,<\/li>\n\n\n\n<li>the <strong>Law of Ukraine \u201cOn State Registration of Legal Entities, Individual Entrepreneurs and Public Associations\u201d<\/strong>,<\/li>\n\n\n\n<li>the <strong>Law of Ukraine \u201cOn the Protection of Rights to Inventions and Utility Models\u201d<\/strong>,<\/li>\n\n\n\n<li>the <strong>Law of Ukraine \u201cOn the Protection of Rights to Industrial Designs\u201d<\/strong>,<\/li>\n\n\n\n<li>the <strong>Law of Ukraine \u201cOn the Protection of Rights to Trademarks for Goods and Services\u201d<\/strong>,<\/li>\n\n\n\n<li>the <strong>Law of Ukraine \u201cOn the Protection of Rights to Layout Designs of Semiconductor Products\u201d<\/strong>,<\/li>\n\n\n\n<li>the <strong>Law of Ukraine \u201cOn Public Electronic Registers\u201d<\/strong>,<\/li>\n\n\n\n<li>the <strong>Law of Ukraine \u201cOn Copyright and Related Rights\u201d<\/strong>.<\/li>\n<\/ul>\n\n\n\n<p><strong>which restricts access of individuals and legal entities to information from electronic registers regarding defense enterprises during the period of martial law in Ukraine, introduced by the Presidential Decree No. 64\/2022 dated February 24, 2022 &#8220;On the Introduction of Martial Law in Ukraine&#8221;, and for one year after its termination or cancellation.<\/strong><\/p>\n\n\n\n<p>According to the authors of the draft law, the implementation of the proposed amendments will contribute to enhancing the security of defense enterprises by limiting the possibility of free and unrestricted access to registry data about defense companies, their types of activities, locations, as well as temporarily restricting access to the location of real estate owned by such enterprises and to data on intellectual property objects related to national security and defense. The goal is to preserve the integrity of such registers while imposing minimal access restrictions for individuals and legal entities.<\/p>\n\n\n\n<p>However, it is important not to overlook the significance and impact of open data, which includes information from public registers. This concerns journalistic investigations, public oversight of politicians, and various projects that rely on public registry data <em>(in particular, the <a href=\"https:\/\/urbandata.online\/\" title=\"\"><strong>URBANDATA<\/strong> <\/a>project)<\/em>.<\/p>\n\n\n\n<p>Given that, for example, information in the Unified State Electronic System in the Field of Construction (USESFC) concerning defense enterprises and others connected directly or indirectly to the military and defense sectors is non-public (i.e., closed), a temporary restriction on access to similar data in state registers appears entirely justified in my opinion.<\/p>\n\n\n\n<p>What is essential, however, is that access to the entire body or a substantial portion of registry data \u2014 especially from the State Register of Real Property Rights and the State Land Cadastre \u2014 is not \u201caccidentally\u201d restricted.<\/p>\n\n\n\n<p>The closure of public registers not only creates challenges for citizens but also opens up vast opportunities for corruption.
